A lawsuit involving a former K-State football player has been ruled on by the Kansas Supreme Court, with an opinion released Friday. The case involves former KSU offensive lineman Kendyl Jacox and Danitra Cain. Cain has been seeking unpaid child support post judment interest.
Jacox played at Kansas State University from 1994-1997 and was in the NFL from 1998 until 2006, with 91 NFL starts. He’s from the Dallas, Texas area.
The state supreme court reversed the Court of Appeals judgment affirming the Riley County district court decision in the matter. The matter has been remanded back to the local court for a calculation of post judment interest owed on child support.
The 11 page opinion goes through the prior review by the Court of Appeals in its unpublished opinion in November of 2013. That appeal was from Riley County District court and Judge Meryl Wilson. Cain was represented by David Troup of Weary Davis of Junction City and Jacox was represented by Blake Johnson and Bentson Oleen of the Oleen Law firm in Manhattan.
Reference is made to the birth of Cain’s daughter in 1998, with Jacox’s child support obligations rising alongside his income. The Kansas Department of Social and Rehabilitation Services at one point claimed Jacox owed nearly $173,654.52 in back payments. The matter has also been heard in Texas district court, with a $136,562.10 determination by that court in 2011.
