The Kansas Court of Appeals has affirmed a Pottawatomie County Court conviction in a second degree murder case. The opinion announced Friday involves State v. Pablo Alberto Gonzalez, who was convicted of unintentional but reckless second degree murder in the fatal shooting of Levi Bishop more than two years ago.
Gonzalez alleged insufficient evidence as well as constitutional, instructional and trial erros. But the state court found no error, affirming the conviction in the January 2014 New Year’s day case.
KMAN extensively covered the trial of Gonzalez in late August of 2014, with several witnesses taking the stand and recounting the early morning Bishop was found dead in a vehicle after Gonzalez claimed the trigger of the gun involved malfunctioned. Gonzalez maintained Bishop was his best friend, and that he was dating Bishop’s sister.
