In a hearing on Tuesday morning a former Kansas State student entered of plea of no contest to two counts of involuntary manslaughter.
25-year-old Miles Theurer plead no contest to the counts after reaching a plea agreement with the prosecution that included the dropping of two counts of aggravated battery.
Theurer is now awaiting sentencing on the charges involving the double fatality accident on K-18 in May 2012. 31-year-old Micheal Stanley and Elizabeth Young of Ogden were killed in the crash, and autopsies revealed the cause of death to be severe trauma from the head on collision.
In court on Tuesday prosecutors laid out key elements in the case. Prosecutors say Theurer was returning home from a strip club in Junction City with his friends when he entered the westbound lane traveling eastbound.
A witness to the accident reportedly made many attempts to alert Theurer that he was in the wrong lane, but couldn’t get him to get into the right lane.
Authorities say Theurer’s blood alcohol content was .190 which is well over the .08 needed to be considered drunk by Kansas law.
Family of the victims say Stanley and Young were in a relationship at the time, and are now survived by four children. Sentencing for Theurer will take place on June 17th at 1:30 p.m.
Theurer faces a minimum of 38 Months in prison, and a maximum of 172 months for each count of involuntary manslaughter while driving under the influence. Prosecutors say the sentences could run consecutively, or concurrently which will be determined at the time of sentencing. Defense attorney Pedro Igonegaray indicated he will be pursuing a departure from those sentences at the time of the sentencing hearing.
