Closing arguments have come to an end and jury deliberation is underway in the case of Levertis Horne.
Horne is facing six charges: two aggravated robbery, two attempted aggravated robbery, aggravated burglary, and aggravated battery.
During closing arguments, the prosecution emphasized the point of why would the occupants of the apartment have robbed Horne? They were in the apartment and it would have drawn the police there, according to Barry Disney.
Disney also presented the 911 call that told of the situation from within the apartment.
The defense attorney Brenda Jordan countered saying the state was trying to bring sympathy by using the call. However, what wasn’t hears on the clips told the story. The defense pointed out there was no commotion heard in the background.
“You would have heard Andrew Johnson calling her name ” said Jordan, defense attorney.
The defense also presented the three casings. If only two shots were fires the gun had to have been in the apartment before this.
Though the prosecution pointed out that after the search of the apartment there were no indications of guns being in the apartment.
Disney said there were no holsters, no other guns, and no extra ammunition.
Also, the prosecution pointed out Chase Cargile was shot twice and based on the location of the wounds those shots were probably in succession which to some people could sound like one shot being fired.
