A man accused of a home invasion in October of 2012 which, according to police, resulted in the shooting of a Kansas State University student, had a retrial hearing on Wednesday afternoon in Riley County District Court.

The Levertis Horne retrial was set for the week of February 3rd and is expected to last 5 days. Jury selection will take place on January 31st.

Levertis Horne is facing two counts of aggravated robbery, two counts of attempted aggravated robbery, aggravated burglary, and aggravated battery. During the incident, authorities say K-State student Chase Cargile was shot in the upper torso.

Horne’s original trial began on Tuesday, August 6th, but was declared a mistrial late Friday, August 9th after 7 hours of jury deliberation.
