The Kansas Court of Appeals has affirmed a Riley County Court conviction in a drug-related case. The opinion in State v. Hudson was released Friday, rejecting Adam Hudson’s (31) appeal in a 2013 case involving cultivation of marijuana and other drug related charges.
The Appeals Court did find the district court erred in responding to the jury’s question in writing rather than reading the answer to the jury in open court in Hudson’s presence. However, the higher court went on to say that error is harmless as there is “no reasonable possibility that it altered or affected the verdict.”
The Court of appeals also addressed Hudson’s argument that the district court denies his motion to suppress, referring to earlier rulings by the State Supreme Court in such matters. Hudson had requested a continuing objection to evidence obtained from the search warrant prior to the start of jury selection. However a review of the record revealed Hudson failed to contemperaneously object to the admission of any of the evidence gathered pursuant to the search warrant.
Hudson is currently being held in El Dorado and his earliest possible release date from the Kansas Department of Corrections is August of 2021. More than 100 marijuana plants were involved in the conviction,with possession with intent to sell within one-thousand feet of a school another conviction.
