Update 7/13/15

Tierre Wall of Fort Riley appeared in court Monday morning for a status hearing.

Wall asked Judge David Stutzman to appoint him an attorney. This comes after Wall requested to hire his own attorney at his last court appearance on June 25th. Wall and his attorney at the time, Mark Dinkel said there was a breakdown in communication between the two.

Another status hearing is scheduled for August 10th.

A preliminary hearing for a Fort Riley man accused of involuntary manslaughter is delayed for a second time because of the defendant’s request for a change in attorney.

Tierre Wall appeared in court alongside his lawyer Mark Dinkel Thursday morning.

Wall requested time to hire his own private lawyer saying, “I don’t want to go into a situation where I feel like I’m left out on my defense.”

Dinkel says there was a “breakdown in communication” between the two, stating he saw his client three times in the past 30 days.

Dinkel also says he was occupied with other obligations at the time.

Judge David Stutzman asked Wall if he knows a request for an attorney change would delay his case, to which Wall replied “I’m left with no choice but to hire an attorney.”

Stutzman granted Wall’s request for time to find his own representation and set a status hearing for July 13th.

In May, Wall’s lawyer at the time, Larry McRell filed a motion to withdraw from the case, citing professional reasons.

The incident Wall is charged with happened on March 10th near Ogden.

According to the affidavit, Casey Lindley’s fiancée went to pick him and her roommates up at Florence Manufacturing where they worked.

A road rage incident apparently occurred on the way home, with Lindley and at least three others approaching a vehicle driven by Wall at Skyway Drive and K-114 Highway.

According to witness reports, Wall pulled out a gun and Lindley told him to put it away several times.

Lindley reportedly swatted at the gun when it was pointed at him, and that’s when witnesses say Wall fired three shots, one of them hitting Lindley in the head.

Witnesses stated Wall drove off in his vehicle toward Junction City.

Lindley was later transported by Lifestar from Mercy Regional Health Center to Stormont Vail in Topeka where he was pronounced dead.

There are also reports from Wall’s family members of him asking for help getting to his truck elsewhere and to the ATM to get cash out less than two hours after the shooting.
