
Timothy Ayers Jr. apologized to the court and his family for the harm he had caused before his sentence was read off by Judge David Stutzman. Factors going into Ayers’ sentencing was his small criminal background, which included a DUI in 1999 followed by an attempted burglary. He also made it known to the court he was willing to seek mental health treatment in the years to come.
He was charged on one count of rape and one count of aggravated indecent liberties with a child. These two charges totaled at 155 months in prison followed by a lifetime of supervision. This means Ayers will not be released from prison until 2028.

(March 30, 2015) A soldier facing charges of rape and indecent liberties with a child, following a December arrest, plead not guilty to both counts on Monday morning in Riley County District Court.
Timothy Ayers Jr. now faces a jury trial this summer after Judge David Stutzman accepted his plea of not guilty. This arrest stems from a warrant in connection with a northern Riley County alleged rape incident that occurred in August.
Prosecuting State Attorney, Barry Wilkerson suggested that four days be set aside for the jury trial. Ayers’s jury trial was set for the week of June 29th.
A request for a restraining order was also made against some of the witnesses. Judge Stutzman did approve the request and the order will be filed.
