    State court affirms Riley County attempted murder conviction

    A Manhattan man’s conviction for attempted murder and battery has been affirmed by the Kansas Court of Appeals. Samuel Dartez, 33, had been sentenced in January of 2016 to more than 22 years with the Kansas Department of corrections for stabbing a 27 year old woman multiple times in November of 2014 near the intersection of Juliette and Yuma Streets.
    In Daretz’s appeal, he contended the district court erred by admitting prior bad acts evidence, improperly instructing the jury, entering an unworkable restitution order, and improperly calculating his sentence. The appellant also asserted prosecutorial error and juror misconduct.
    However the state court of appeals did not view it that way, indicating in its 15 page opinion no reversible error in the case. Again the Kansas Court of Appeals affirmed Dartez’s conviction in the nearly three year old case.
