Federal judge rules in favor of state in lawsuit against Biden administration policy

Kansas Attorney General Kris Kobach answers questions from reporters during a news conference outside his office May 1, 2023, in Topeka, Kan.

A federal judge sided with a lawsuit filed by Kansas attorney general Kris Kobach that strikes down a rule from the Biden administration that provides Obamacare benefits to illegal immigrants who signed up under the DACA program.

The new policy was introduced by the White House in May leading to the lawsuit being filed by 18 Attorneys Generals from Republican-led states arguing that the law does not apply to persons living in the country illegally.

Kobach said the ruling is a “big win for the rule of law” and the Affordable Care Act never was intended to provide “healthcare to illegal immigrants.” The DACA program is known by the full title of Deferred Arrival for Childhood Arrivals. The program was established under the Obama administration in 2012. Currently, there are a little over 4300 DACA recipients in the state of Kansas.
