A Fort Riley man facing a voluntary manslaughter charge in Riley County made the request in county court on Thursday morning for his defense attorney to withdraw from the case. A preliminary hearing was set to take place, however, Tierre Wall’s attorney, Larry McRell informed Judge David Stutzman of the change in plans.An affidavit released in March described details regarding an alleged road rage incident involving Wall, which resulted in a shot hitting Casey Lindley in the head.
McRell informed the court he has professional reasons for wanting to file the motion to withdraw as Wall’s attorney. He affirmed it is not a personal conflict. When asked by Judge Stutzman if he agreed to this, Wall stated “It would be unfair to go forward with this particular conflict”.
Stutzman did accept the motion for McRell to withdraw, but did state this will delay the case until another attorney is appointed.
Once counsel is appointed for the case, scheduling will take place as far as how to proceed.
