The Kansas Court of Appeals issued opinions Friday on three area cases, affirming two and reversing one.
A Riley County case involving Travis Day pertained to a battery on a law enforcement case from last year and was affirmed by the higher court. In appealing, Day contended there was insufficient evidence to support the crime. But the Court of Appeals found evidence that Day spat on a law enforcement officer which is sufficient to constitute battery, affirming Riley county District Court’s judgment.
A Pottawatomie County case with an appeal from Christine Anderson on her interference with law enforcement conviction was also affirmed. Anderson also alleged insufficient evidence but the higher court found there was in fact sufficient evidence in the case.
State v Frank Crudo in Geary County was appealed due to a district court order suppressing 19 pounds of marijuana seized by the Geary County Sheriff’s Department from a trailer owned by Frank Crudo. The state court of appeals reversed the suppression order and remanded the case to the district court for a new evidentiary hearing before another district judge with directions to reconsider the motion.
