    UPDATE: Prominent Manhattan businessman arrested

    A copy of the complaint filed to Riley County District Court was obtained by KMAN today.

    It reads as follows:

    Copy of Complaint/Information in State of Kansas v. Zachary Jon Burton (electronically filed June 7 with Clerk of Riley County District Court):

    Barry K Disney, Senior Deputy Riley County Attorney, of Riley County, of lawful age,
    being first duly sworn on oath, for complaint against the above shown defendant, in the name and by the authority on behalf of the State of Kansas, gives the Court to understand and be informed:
    COUNT 1: That between the 1st day of December, 2015 and the 31st day of December, 2015, in Riley County, Kansas, Zachary Burton engaged in consensual sexual intercourse with K.S., a person to whom he is not married, and at the time of the consensual sexual intercourse K.S. was over the age of 16 and was a student enrolled at a public school offering any grades kindergarten through 12th and where Zachary Burton was employed as a teacher
    or held a position of authority. Unlawful Sexual Relations, a severity level 5 person felony contrary to K.S.A. 21-5512(a)(9) (Penalty: K.S.A. 21-6801 et. seq)

    COUNT 2: That between the 1st day of December, 2015 and the 31st day of January, 2016, in Riley County, Kansas, Zachary Burton engaged in consensual sexual intercourse with K.S., a person to whom he is not married, and at the time of the consensual sexual intercourse K.S. was over the age of 16 and was a student enrolled at a public school offering any grades kindergarten through 12th and where Zachary Burton was employed as a teacher or held a position of authority. Unlawful Sexual Relations, a severity level 5 person felony contrary to K.S.A. 21-5512(a)(9) (Penalty: K.S.A. 21-6801 et. seq)

    COUNT 3: That between the 1st day of December, 2015 and the 31st day of March, 2016, in Riley County, Kansas, Zachary Burton engaged in consensual sexual intercourse with K.S., a person to whom he is not married, and at the time of the consensual sexual intercourse K.S. was over the age of 16 and was a student enrolled at a public school offering any grades kindergarten through 12th and where Zachary Burton was employed as a teacher or held a position of authority.     COUNT 4: That between the 1st day of December, 2015 and the 9th day of May, 2016, in Riley County, Kansas, Zachary Burton engaged in consensual sexual intercourse with K.S., a person to whom he is not married, and at the time of the consensual sexual intercourse K.S. was over the age of 16 and was a student enrolled at a public school offering any grades kindergarten through 12th and where Zachary Burton was employed as a teacher or held a position of authority. Unlawful Sexual Relations, a severity level 5 person felony contrary to K.S.A. 21-5512(a)(9) (Penalty: K.S.A. 21-6801 et. seq)

    More details on the the arrest of the owner of Fieldhouse Development, Inc. were made available in Wednesday’s official arrest report from the Riley County Police Department.

    Zac Burton, who was arrested early Tuesday evening involving unlawful sexual relations with a female student, is being charged with four counts of the offense.

    KMAN received word shortly after 5 p.m. Tuesday of the arrest of Zac Burton, owner of Fieldhouse Development in Manhattan and a former K-State football player. Burton also was an assistant boys’ basketball coach at Riley County’s USD 378.

    The 38-year-old was taken into custody at about that time and faces charges involving unlawful sexual relations, allegedly involving a female student at Riley County’s USD 378. Riley County Police Public Information Officer Matthew Droge told KMAN Tuesday evening the specific charges were not yet available but would be released Wednesday morning. Bond is $50,000.

    As KMAN reported May 25, USD 378 Interim Superintendent Nancy Meyer confirmed her district was working with the Riley County Police as they investigated an employee. KMAN also shared a photo (above) of a CSI van on Bluemont Avenue that same night near the Fieldhouse Development office on Bluemont Avenue. Droge at that time told KMAN a search warrant was conducted in relation to an investigation outside of Manhattan in Riley County.
