    Kansas Court of Appeals Rules in Two Riley County Cases

    The Kansas Court of Appeals Friday had a mixed bag of opinions in a Riley County case involving aggravated criminal sodomy and indecent liberties with a child. The opinion regarding Fort Riley soldier George Ferenz, 32, relates to a September 2013 conviction.
    The Court of Appeals affirmed in part, reversed in part, but also vacated in part the Riley County District court’s rulings in the case.
    The court reversed two of the counts against Ferenz, indicating they shouldn’t have been split according to who touched who–but lumped together into one count–which applies to incidents reported in a bed and shower as one conviction for each location instead of two.
    Ferenz’s argument about a defective complaint as to aggravated criminal sodomy charges failed, according to the higher court. And the court found no merit in Ferenz’ claim that the district court failed to rule on his motion for a sentencing departure.
    A lifetime postrelease supervision was vacated by the Court of Appeals.
    In effect though by reversing two counts and affirming two, Ferenz will remain in jail on a life sentence.

    The Kansas Court of Appeals has affirmed a Riley County court ruling in a cultivation of marijuana case. The opinion released Friday indicates affirmation of the lower court decision in the case of  Gregory Chambers, 45, who was convicted in the February 2013 case, which also includes possession charges.
    Chambers is being held at the Norton  Correctional facility, with the earliest possible release date in November of 2019.
